2. Notice of infringement
A valid notice must include:
- A physical or electronic signature of the rights holder or authorized agent.
- Identification of the copyrighted work claimed to be infringed.
- Identification of the allegedly infringing material and information reasonably sufficient to locate it (e.g. IP address, date, and time with time zone).
- Your contact information (address, phone, email).
- A statement that you have a good-faith belief the use is not authorized by the rights holder, its agent, or the law.
- A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the rights holder.
3. Our response
As a provider of network connectivity, Sixto Fiber generally does not host customer content. Where we act as a conduit, we will forward valid notices to the affected customer. Where we do host or cache material, we will remove or disable access to it upon receipt of a valid notice and notify the customer.
4. Counter-notification
A customer who believes material was removed or disabled by mistake or misidentification may submit a counter-notice to the agent above containing the elements required by 17 U.S.C. § 512(g)(3). We may restore the material in 10–14 business days unless the original complainant files a court action.
5. Repeat infringers
Sixto Fiber maintains a policy of suspending or terminating, in appropriate circumstances, the account of any customer who is the subject of two or more validated infringement notices within any 12-month period. We track notices per account and notify the customer at each step.
6. Misrepresentation
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or was removed by mistake, may be liable for damages.
