Terms of Service
1. Service
Sixto Fiber provides fixed fiber internet access at the service address on your order, at the tier and speed specified. Service begins on the activation date and continues for the term shown on your order, then renews month-to-month unless either party gives at least 30 days’ written notice.
2. Installation and equipment
We install and own the optical network terminal and related facilities. You provide safe access, adequate space, and power. Equipment we provide remains our property and must be returned in good condition on termination; unreturned equipment may be billed at replacement cost.
3. Fees and billing
Monthly fees are billed in advance; usage-based or one-time charges are billed in arrears. Payment is due within 30 days of the invoice date (Net 30). Late amounts may accrue interest at the lesser of 1.5% per month or the maximum allowed by law. Taxes, surcharges, and regulatory fees are your responsibility.
4. Service levels
Applicable uptime commitments, response targets, and service-credit remedies are stated in the SLA for your plan (see Plans & Pricing). Service credits are your sole and exclusive remedy for failure to meet an SLA target.
5. Acceptable use
Your use of the service is governed by the Acceptable Use Policy and the Copyright / DMCA Policy, which are part of these terms.
6. Suspension and termination
We may suspend or terminate service for non-payment, violation of the AUP, or risk to the network, with notice where practicable. Early termination by the customer before the end of the term may incur the early-termination fee stated on the order (see each plan’s Plan Facts).
7. Warranties and liability
Except as expressly stated in the SLA, the service is provided “as is.” To the maximum extent permitted by law, Sixto Fiber is not liable for indirect, incidental, or consequential damages, and its total liability is limited to the amounts you paid for the affected service in the three months before the claim.
8. Governing law and disputes
These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. The state and federal courts located in Arapahoe County, Colorado have exclusive jurisdiction over any dispute, and each party consents to venue there.
9. Changes
We may modify these terms on notice. If a change materially and adversely affects you, you may terminate the affected service without early-termination fee within 30 days of the notice.
